Hi All the story goes as follows, Bought a bike from a fellow dog in a different Province bit risky but hey he is a fellow dog so quite relaxed about the purchase as in my opinion and previous dealings I have had on this forum all dogs are nice guys.

I bought the bike knowing that it had undergone a motor rebuild top and bottom so I was not concerned about the hours the bike had done etc, seller promised to send me the bill from the Bike shop in JHB that did the rebuild. I bought the bike Dec and have still not received this from the seller after asking many many times for this.
Anyway bike shipped to Cape Town received the bike did a mellow ride through the Bavians with my wife low key and most enjoyable. After that had three more rides on the bike so clocked up 10hrs since Dec which is not allot, took off indicators, number plate etc and had sticker kit made for race numbers and was getting ready to do my first race on the bike!
Took the bike to Bike Shop in Cape Town for race prep, needed front sprocket and oil change not much so I hung around, the mechanic called me over and showed me a piece of a circlip that came out with the oil and allot of fillings, checked the oil screen and also full of filings. These pieces are from another failure as the the current piston has both circlips and all the rings? Quick change of plans and had to race my 300.
I then contacted the seller and told him what I found in the oil and he was oblivious to this and shrugged it off, my mechanic said we need to split this motor which he did the next week and came across the other half of a circlip plus what he thinks are pieces of an oil ring, these bits had been flying around in this motor for the 10 hrs I had ridden it and also destroyed the oil pump gear and idler gear so no oil was going to the rockers so they are damaged as well.
Strange thing is that the bike thinking about it now did sound a little rougher but not as rough as one would think with all these bits floating around. I then contacted the seller again and told him that I think the bike shop that did the rebuild is not being truthful and they need to tell him what was done to the bike. He then sent me a half completed job card from this bike shop but still no invoice. This to me is still very puzzling as the cheapest rebuild cant be anything less than R20, 000 so I said to the seller who told me he still has not received the bill how can a bike shop do a job in Dec and 5 months down the line still not send an invoice, no bike shop I know is doing so well that they let their clients pay 6 months later for a job of this magnitude. Seller pleads ignorant and tells me he is not technical so does not understand this, my assumption is that only the bottom end was done and later the top end must have failed all they did was re sleeve barrel and put new piston and rings in but failed to clean out the bottom end, perhaps they flushed it but this was not enough they should have split the motor again. So not having any joy from the Seller I called the bike shop and spoke to the owner he was no help and just said it was not possible for these bits of old circlip and rings to be in the motor I told him they were? I asked him how he can do a motor rebuild and not charge the client he had some story as to why this had not been done.
Turns out the bike shop owner is good mates with the sellers brother! not going to get anywhere here. I then get hold of MIOSA the so called Ombudsman and plead my case to them they come back to me and dis me off as well and say they don't deal with cash compensation cases so i ask you what do they do ? I have been informed since then by many people who have dealt with them that they are useless. So now I need to get the bike fixed and ask my bike shop to give me a quote which they do and it comes to R34, 871 rand now I need to add this to the R77, 000 I paid for the bike so I end up spending R111 871 for a bike which is only worth R77 000 not cool. I ask the seller if he is prepared to help me in anyway and he lets me know that he is not prepared to help me at all. My question to you fellow dogs is what do I do he has breached the contract by not sending me the original invoice of the work that was done on the bike. ( I should never have bought the bike before I had this) he promised me this many times. How does someone sleep at night knowing that this has happened I have sold many bikes in my day and would never do anything like this to anybody full disclosure is the only way in my mind. Any advice will be greatly appreciated.
